When you apply to be represented as a creator, we collect:

  • Your name, email address, and phone number;
  • Your YouTube channel URL, subscriber count, and average views;
  • Your tech sub-niche (for example, smartphones, PC building, or software);
  • Audience information such as top audience countries and audience age and gender breakdown;
  • Current or past sponsors and your typical sponsorship rates;
  • Whether you agree to receive text messages (marketing and/or non-marketing) and whether you opt in to email updates.

Information you give us: brand inquiries

When you submit a brand or sponsorship inquiry, we collect:

  • Your name, role or job title, work email address, and phone number;

Information from calls, bookings, and payments

  • Bookings and meetings: when you book a call through our scheduling calendar, we receive your name, contact details, chosen time, and any answers you provide. Calls are generally held on Google Meet.
  • Payments: if you pay us (for example, a brand paying for a campaign), payments are processed by Stripe. We do not store full card numbers on our systems. If you are a represented creator, we may collect the payout details needed to pay you (for example, a PayPal email or bank account details) and tax information required by law (such as a Form W-9 or W-8).
  • Communications: the content of emails, text messages, and other messages you send us.

Information collected automatically

When you use the Site, we and our service providers may automatically collect technical information such as your IP address, browser and device type, pages viewed, referring URL, approximate location (city/region level), and the date and time of your visit. See Cookies and analytics.

Public information

To evaluate creator applications and plan brand campaigns, we may review publicly available information, such as your public YouTube channel, videos, and public channel statistics.

2. How we use information

We use personal information to:

  • Review creator applications and decide whether we can offer representation;
  • Respond to brand inquiries, recommend creators, and prepare proposals and statements of work;
  • Schedule and hold calls and meetings;
  • Negotiate, manage, and deliver sponsorships and campaigns for represented creators and brand clients;
  • Process payments, invoices, commissions, and creator payouts, and keep required tax and accounting records;
  • Send service-related messages (for example, application status, appointment reminders, and campaign updates);
  • Send marketing emails or text messages, only where you have opted in or where otherwise allowed by law;
  • Operate, secure, analyze, and improve the Site and our services;
  • Prevent fraud and abuse, comply with law, and enforce our Terms of Service.

We do not sell your personal information.

3. How we share information

We share personal information only as described below:

  • Service providers who process information on our behalf and under our instructions, including: GoHighLevel / LeadConnector (website, forms, CRM, email, and SMS delivery); Google Workspace (email, documents, storage, calendar, and Google Meet); Stripe (payment processing); and PayPal and our bank (creator payouts). These providers may use information only to provide services to us.
  • Brands and creators, as part of our services: if you are a represented creator, we share relevant channel and audience information, rates, and media-kit details with prospective brand partners to pitch and secure deals. If you are a brand, we share relevant campaign details with creators we are considering for your campaign. We share only what is reasonably needed for that purpose.
  • Legal and safety: when we believe disclosure is required by law, subpoena, or legal process, or is needed to protect the rights, property, or safety of Fluence Social, our users, or others.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business, subject to this Policy. SMS opt-in data and consent are not transferred for marketing purposes as part of any such transaction.
  • With your consent or at your direction.

Mobile information is never shared for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of sharing described above exclude text messaging originator opt-in data and consent; this information will not be shared with, sold to, rented to, or transferred to any third parties or affiliates. Information may be shared with service providers that help us deliver text messages (such as our messaging platform and wireless carriers) solely to send the messages you asked to receive.

4. SMS / text messaging

On our creator application form, you may choose to receive text messages from Fluence Social. There are separate, optional checkboxes for:

  • Non-marketing (service) messages, such as application status updates, appointment confirmations and reminders, and replies to your questions; and
  • Marketing messages, such as news about our creator program, opportunities, and offers.

Consent is optional. Consent to receive text messages is not a condition of applying, of representation, or of purchasing any goods or services. You can apply and work with us without agreeing to receive texts.

Message frequency varies. Message and data rates may apply.

Reply STOP to any message to opt out at any time. After you text STOP, we will send one final message confirming you have been unsubscribed and will send no further texts unless you opt in again. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT.

Reply HELP for help, or contact us at [email protected].

Carriers are not liable for delayed or undelivered messages.

How we use SMS data. We use your mobile number and SMS consent records only to send the messages you agreed to receive, to honor opt-out requests, and to keep records of consent as required by law. We do not share or sell mobile numbers or SMS opt-in data and consent to third parties or affiliates for marketing or promotional purposes.

If you change or cancel your mobile number, please text STOP from that number or email us so we can stop messaging it. Full SMS program terms are in our Terms of Service.

5. Email communications

If you opt in, we may send you marketing emails about our services, creator opportunities, and industry updates. Every marketing email we send will:

  • Identify Fluence Social as the sender and use accurate subject lines;
  • Include our physical mailing address: [Business address]; and
  • Include a clear unsubscribe link.

You can unsubscribe at any time by clicking the unsubscribe link in any marketing email or by emailing [email protected]. We will process unsubscribe requests within 10 business days. Even after you unsubscribe from marketing emails, we may still send transactional or relationship messages (for example, about your application, a booked call, an active campaign, or payments).

6. Cookies and analytics

We and our service providers use cookies, pixels, local storage, and similar technologies to:

  • Make the Site and forms work (for example, keeping a form session active and preventing spam);
  • Remember preferences;
  • Understand how visitors use the Site (analytics), such as pages visited and traffic sources;
  • Measure the effectiveness of our marketing, which may include advertising or analytics tools such as [list analytics/ad tools, e.g., Google Analytics, Meta Pixel, if used].

You can control cookies through your browser settings, including blocking or deleting them. Blocking some cookies may affect how the Site or forms work. Some browsers send "Do Not Track" signals; because there is no common industry standard for these signals, the Site does not currently respond to them. Where required by law, we will honor recognized opt-out preference signals such as Global Privacy Control.

7. Data retention

We keep personal information only as long as reasonably needed for the purposes described in this Policy, including to meet legal, tax, accounting, and dispute-resolution needs. As a general guide:

  • Creator applications that do not lead to representation, and brand inquiries that do not lead to a signed agreement: kept for up to [24 months] after our last contact, so we can revisit future opportunities, unless you ask us to delete them sooner.
  • Represented creators and brand clients: kept for the length of the relationship plus up to [7 years] for contract, tax, and accounting records.
  • SMS consent and opt-out records: kept for at least [4 years] after your last interaction to demonstrate compliance with telemarketing laws.
  • Marketing email suppression lists: kept as long as needed to make sure we do not email you after you unsubscribe.

When information is no longer needed, we delete it or de-identify it.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, such as access controls, multi-factor authentication on business accounts, encrypted connections (HTTPS), and reputable service providers. Payment card data is handled by Stripe, which is certified to PCI DSS standards. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we learn of a security incident that affects your personal information, we will notify you as required by law.

9. Children and age requirements

The Site and our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, contact us and we will delete it.

Creators who apply for representation must be at least 18 years old. Creators under 18 may apply only with the consent and involvement of a parent or legal guardian, who must review this Policy and any representation agreement and sign on the minor's behalf where required. Brand inquiries must be submitted by adults authorized to act for their company.

10. Your choices and rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you and receive a copy in a portable format;
  • Correct inaccurate information;
  • Delete your personal information, subject to legal exceptions (for example, records we must keep for tax purposes);
  • Opt out of marketing emails and texts, of the sale or sharing of personal information for targeted advertising, and of certain profiling (we do not sell personal information or use it for profiling that produces legal or similarly significant effects);
  • Not be discriminated against for exercising your rights.

To make a request, email [email protected] with the subject line "Privacy Request." We will verify your identity before acting on the request, usually by confirming details we already have. You may use an authorized agent where the law allows; we may ask for proof of their authority. We will respond within the time required by applicable law (generally 45 days). If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Appeal," and we will respond to your appeal within the time required by law.

11. California and Texas residents

California

If you are a California resident, you may have rights under California privacy laws, including the California Consumer Privacy Act (as amended by the California Privacy Rights Act), to the extent those laws apply to us. In general terms: in the past 12 months we have collected the categories of information described in Section 1 (identifiers, commercial information, internet activity, professional information, and, for creators, audience and business information) for the purposes in Section 2, and disclosed them to the categories of recipients in Section 3. We do not sell personal information, and we do not knowingly sell or share the personal information of consumers under 16. Under California's "Shine the Light" law, you may ask whether we disclosed personal information to third parties for their direct marketing purposes; we do not do this.

Texas

If you are a Texas resident, you may have rights under the Texas Data Privacy and Security Act, to the extent it applies to us, including rights to access, correct, delete, and obtain a copy of your personal information, and to opt out of the sale of personal information, targeted advertising, and certain profiling. We do not sell personal information, including sensitive personal information. You may exercise your rights and appeal any decision as described in Section 10. If your appeal is denied, you may contact the Texas Attorney General.

Other states

Residents of other U.S. states with privacy laws may have similar rights. Contact us and we will honor requests as required by applicable law.

12. International visitors

We are based in the United States, and our service providers may process information in the United States and other countries. If you use the Site or our services from outside the U.S., your information will be transferred to, stored, and processed in the U.S., where data protection laws may differ from those in your country.

13. Third-party links and platforms

The Site may link to third-party websites and platforms (such as YouTube, Google, or brand websites). We are not responsible for their privacy practices. Please review their privacy policies before sharing information with them.

14. Changes to this policy

We may update this Policy from time to time. When we do, we will change the "Effective date" above and, if the changes are material, we will provide additional notice (for example, by email or a notice on the Site). Changes will not apply retroactively to SMS consent you have already given; we will not use your mobile number in a materially different way without your consent.
